Digital Millennium Copyright Act

Zoints is an Online Service Provider under Title II of the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA") and as such will respond to notices of alleged infringement that are issued in compliance with the DMCA and procedures set forth below. The text of the DMCA may be found at the website of the US Copyright Office: http://lcWeb.loc.gov/copyright/

Infringement Notification

1. ONLY the owner of a copyrighted work(s), or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed may file a notification with Zoints.
2. All notices of infringement must be sent via regular mail unless a previous arrangement has been made. Understand that the notification is signed under penalty of perjury and you will be liable if you materially misrepresent that an activity or product is violating your copyright.
3. To file a DMCA notice with Zoints, provide the following information in the listed format:
   1. Identify your legal connection to the copyrighted work in question. For example, indicate if you are the copyright owner or legal agent of the copyright owner.
   2. Provide sufficient detail about the copyrighted work and location of said work so Zoints can locate it. For example, "The infringed work is the video located at [specific Zoints url]".
   3. Provide your contact information, including your full legal name, street address, telephone number, and email address.
   4. State that you have "a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agents, or the law."
   5. State, "I swear, under penalty of perjury, that the provided information contained within this notification is accurate and I am the copyright owner or authorized to act on behalf of the copyright owner of the allegedly infringed material."
   6. Sign the notification and print your name below the signature.
   7. Send the notification (via registered or certified mail) to:

Counter Notification

Upon receipt of a proper notification, the allegedly infringed material will be removed and Zoints will make a good faith effort to contact the individual who uploaded it so they have the opportunity to make a counter notification pursuant to sections 512(g)(2) and (3) of the Digital Millennium Copyright Act. If we receive a counter notification, we will reinstate the material in question.

To file a counter notification, follow these steps:

1. State that access to your content was disabled due to operation of the notice and takedown procedure.
2. Identify the material that has been removed and designate its URL prior to removal.
3. State, under penalty of perjury:
   1. Your full legal name, address, email, and telephone number,
   2. That you "have a good faith belief that the material was removed or disabled as result of mistake or misidentification of the material,"
   3. That you "consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located."
   4. Sign the document and print your name below the signature.
   5. Send the counter notification to:
